County Ordinance 364

Official Wording:
Shall the SHELBY COUNTY CHARTER be amended to:

(1) create county charter officers to replace the former constitutional Sheriff, Trustee, Register, County Clerk, and Assessor with the same duties, functions, obligations, rights, power and authority;
(2) give those officers the same constitutional titles and state law qualifications, compensation, and method of removal as the former constitutional officers;
(3) set the Sheriff’s compensation at 80% to 95% of the County Mayor’s salary but reduce it for failure to have certain corrections-related qualifications within a specific time period;
(4) require these officers be elected to four-year terms;
(5) provide a method for recall of these officers;
(6) require the chief deputy be designated to fill vacancies in these offices;
(7) prohibit officers from suing the County to challenge the personnel budget, but allow the Sheriff to challenge by binding arbitration;
(8) delete Section 4.06, which refers to the former constitutional Sheriff; and
(9) change the title of Article IV to “Judicial Branch,”

effective September 1, 2010, but effective September 1, 2012 as to the Shelby County Assessor who will serve two years beginning September 1, 2012, then four-year terms beginning in 2014 and each four years thereafter with the other four officers

Explanation: Establishes the offices of Sheriff, Trustee, Register, County Clerk, and Assessor as county charter positions. They were formerly constitutional offices.
• Necessary due to legal challenges. Based in Knox County.
• Requires no effective changes to those offices.
